Living Wills (Advanced Directives)

A Living Will also known as an Advance Directive is a set of instructions issued to medical practitioners in advance to allow them to stop prolonging life by artificial means in the event of a testator becoming terminally ill or suffering from a degenerative condition. Living Wills The Living Will is a statement in which a person sets out in advance the kind of medical treatment they wish to or do not wish to receive in the event that they subsequently become incapable of communicating their own wishes. They allow a person to make a dignified decision about future events, which may or may not happen. Euthanasia is and will be for the foreseeable future continue to be illegal in this country. A Living Will in not taking an active step to hasten one's death but expresses a desire for life not to be prolonged unnecessarily. The medical profession have a duty to provide basic care, which includes oral nutrition and hydration. Living Wills have been valid at Common Law in this country for several years. They require very careful drafting as there are several pre-requisites for making a valid Living Will and we would recommend full professional advice is taken to ensure the document's validity.
